Contract privity act 1982

The Contracts (Privity) Act 1982 does not destroy the doctrine ofprivity ofcontract, but modifies it, by allow­ ing, in certain circumstances, third parties to sue on a contract in respect ofa promise made in their favour.

The phrase "purport to confer a benefit" was originally found in the 1937 Law Commission paper, and was used in the New Zealand Contracts (Privity) Act 1982 before it was adopted for the English act. The third party must be identified by name or as a member of a particular group, and does not need to exist when the contract was made. The Contracts (Privity) Act 1982 will bring this much needed reform. II. THE CONTRACTS (PRIVITY) ACT 1982 A. The Effect ofSection 4 Section4 ofthe Act is the enabling section which allows enforceable rights to be bestowed by contract on third parties. It reads as follows: Where a promise contained in a deed ofcontract confers, or purports to confer, a New Zealand has enacted the Contracts Privity Act 1982, which enables third parties to sue if they sufficiently identified as beneficiaries by the contract, and in the contract it is expressed or implied they should be able to enforce this benefit. Additionally, the 1999 Act does not alter the legal position, including the exceptions, under common law, which continue to be applied by courts
